Tex. Local Gov't Code Section 42.025
Release of Extraterritorial Jurisdiction by Certain Municipalities


(a)

In this section, “eligible property” means any portion of a contiguous tract of land:

(1)

that is located in the extraterritorial jurisdiction of a municipality within one-half mile of the territory of a proposed municipal airport;

(2)

for which a contract for land acquisition services was awarded by the municipality; and

(3)

that has not been acquired through the contract described by Subdivision (2) for the proposed municipal airport.

(b)

The owner of eligible property may petition the municipality to release the property from the municipality’s extraterritorial jurisdiction not later than June 1, 1996. The petition must be filed with the secretary or clerk of the municipality.

(c)

Not later than the 10th day after the date the secretary or clerk receives a petition under Subsection (b), the municipality by resolution shall release the eligible property from the extraterritorial jurisdiction of the municipality.

(d)

Eligible property that is released from the extraterritorial jurisdiction of a municipality under Subsection (c) may be included in the extraterritorial jurisdiction of another municipality if:

(1)

any part of the other municipality is located in the same county as the property; and

(2)

the other municipality and the owner agree to the inclusion of the property in the extraterritorial jurisdiction.
