Tex. Occ. Code Section 203.004
Applicability

This chapter does not apply to:

(1)

a certified nurse-midwife, a physician, or another health care professional licensed by the state and operating within the scope of the person’s license;

(2)

a natural childbirth trainer; or

(3)

a person other than a midwife who assists childbirth in an emergency.
