Tex. Gov't Code Section 401.065
Expenditure for Emergency


(a)

The governor may spend appropriations made under Section 401.061 (Appropriations for Emergency) for the purpose of a certified emergency, but only after:

(1)

the certification is endorsed by the comptroller showing that money other than emergency appropriations is not available for purposes of the emergency; and

(2)

the governor receives the certification from the comptroller.

(b)

The comptroller shall draw and pay the necessary warrants for the emergency.

(c)

The governor by interagency contract may authorize an agency of the executive branch of state government to administer emergency appropriations approved under this subchapter. A contract made under this subsection is exempt from Chapter 771 (Interagency Cooperation Act).
