Manufacturer’s License


(a)

A person manufacturing, storing, possessing, and selling fireworks constructed by that person must have a manufacturer’s license.

(b)

The commissioner shall set and collect an annual manufacturer’s license fee in an amount not to exceed $1,000.

(c)

A licensed manufacturer may sell:

(1)

Fireworks 1.4G only to a licensed distributor or jobber; and

(2)

Fireworks 1.3G only to a licensed distributor or pyrotechnic operator, or to a fireworks public display permit holder for use in public fireworks displays in this state.

(d)

A licensed manufacturer may manufacture, store, possess, and sell an item other than a permissible firework if the item is only for sale and delivery to authorized persons in a state in which the item is permissible.

(e)

A licensed manufacturer may be required to submit samples of all fireworks to the state fire marshal for approval.
