Tex. Occ. Code Section 501.401
Grounds for Disciplinary Action

The executive council shall take disciplinary action under Subchapter G, Chapter 507 (Texas Behavioral Health Executive Council), against a license holder who:

(1)

violates this chapter or a rule adopted under this chapter;

(2)

is convicted of a felony or of any offense that would be a felony under the laws of this state, or of a violation of a law involving moral turpitude;

(3)

uses drugs or alcohol to an extent that affects the person’s professional competency;

(4)

engages in fraud or deceit in connection with services provided as a psychologist;

(5)

except as provided by Section 501.263 (Temporary License):

(A)

aids or abets the practice of psychology by a person not licensed under this chapter in representing that the person is licensed under this chapter;

(B)

represents that the person is licensed under this chapter to practice psychology when the person is not licensed; or

(C)

practices psychology in this state without a license under this chapter or without being qualified for an exemption under Section 501.004 (Applicability); or

(6)

commits an act for which liability exists under Chapter 81 (Sexual Exploitation by Mental Health Services Provider), Civil Practice and Remedies Code.
