Tex. Health & Safety Code Section 33.036
Denial, Modification, Suspension, and Revocation of Eligibility to Receive Services


(a)

After notice to the individual or, if the individual is a minor, the individual’s parent, managing conservator, or guardian and an opportunity for a fair hearing, the department may deny, modify, suspend, or revoke the determination of a person’s eligibility to receive services at no cost or at reduced cost under this chapter.

(b)

Notice shall be given and the hearing shall be conducted in accordance with the department’s informal hearing procedures.

(c)

Chapter 2001 (Administrative Procedure), Government Code, does not apply to the notice and hearing required by this section.
