Tex. Human Resources Code Section 23.012
Motion to Revoke Stay


(a)

The commission may file a motion with the commission’s appeals division to revoke the stay of an order suspending a license if the person does not comply with the terms of a reasonable repayment plan entered into by the person.

(b)

Notice to the person of a motion to revoke stay under this section may be given by personal service or by mail to the address provided by the person, if any, in the order suspending a license. The notice must include a notice of hearing before the appeals division. The notice must be provided to the person not less than 10 days before the date of the hearing.

(c)

A motion to revoke stay must allege the manner in which the person failed to comply with the repayment plan.

(d)

If the commission finds that the person is not in compliance with the terms of the repayment plan, the commission shall revoke the stay of the order suspending a license and render a final order suspending a license.
