Tex. Ins. Code Section 830.001
Applicability and Purpose


(a)

This chapter applies to each domestic insurer unless exempt under Section 830.006 (Exemption).

(b)

The purpose of this chapter is to provide the requirements for maintaining a risk management framework and completing an own risk and solvency assessment and to provide guidance and instructions for filing an own risk and solvency assessment summary report with the commissioner.

(c)

The own risk and solvency assessment summary report will contain confidential and sensitive information related to an insurer or insurance group’s identification of risks material and relevant to the insurer or insurance group filing the report. This information will include proprietary and trade secret information that has the potential for harm and competitive disadvantage to the insurer or insurance group if the information is made public. The summary report is a confidential document filed with the commissioner, and the commissioner may share the summary report only as stated in this chapter in order to assist the commissioner in the performance of the commissioner’s duties. An own risk and solvency assessment summary report is not subject to public disclosure in any event.
