Tex. Health & Safety Code Section 282.006
Election Costs; Disposition of Deposit


(a)

The county clerk shall retain the amount deposited under Section 282.004 (Petition for Election)(a) until the commissioners court declares the election results.

(b)

If at the election the majority of the voters approved the creation of the district, the county clerk shall return that amount to the petitioners or the petitioners’ agent or attorney.

(c)

If at the election the majority of the voters disapproved the creation of the district, the county clerk shall:

(1)

pay from the amount deposited on warrants approved and signed by the county judge, all costs and expenses pertaining to the proposed district, including the costs related to the elections;

(2)

return the remaining amount, if any, to the petitioners or the petitioners’ agent or attorney.
