Tex. Civ. Practice & Remedies Code Section 171.050
Depositions


(a)

The arbitrators may authorize a deposition:

(1)

for use as evidence to be taken of a witness who cannot be required by subpoena to appear before the arbitrators or who is unable to attend the hearing; or

(2)

for discovery or evidentiary purposes to be taken of an adverse witness.

(b)

A deposition under this section shall be taken in the manner provided by law for a deposition in a civil action pending in a district court.
