Tex. Civ. Practice & Remedies Code Section 171.097
Transfer


(a)

On application of a party adverse to the party who filed the initial application, a court that has jurisdiction but that is located in a county other than as described by Section 171.096 (Place of Filing) shall transfer the application to a court of a county described by that section.

(b)

The court shall transfer the application by an order comparable to an order sustaining a plea of privilege to be sued in a civil action in a district court of a county other than the county in which an action is filed.

(c)

The party must file the application under this section:

(1)

not later than the 20th day after the date of service of process on the adverse party; and

(2)

before any other appearance in the court by that adverse party, other than an appearance to challenge the jurisdiction of the court.
