Tex. Water Code Section 37.010
Advertising


(a)

The commission may not adopt rules restricting advertising or competitive bidding by a license or registration holder except to prohibit false, misleading, or deceptive practices.

(b)

In its rules to prohibit false, misleading, or deceptive practices, the commission may not include a rule that restricts:

(1)

the use of any medium for advertising;

(2)

the use of a license or registration holder’s personal appearance or voice in an advertisement;

(3)

the use or duration of an advertisement by the license or registration holder; or

(4)

the license or registration holder’s advertisement under a trade name.
